This article introduces the conflictual theory of law as a new way of understanding laws as struggles over meaning, in which actors create and circulate social knowledge to justify their interpretation of rights. The theory addresses law-production processes and underlying knowledge/power constructs, for example, in legislative deliberations and interactions between politicians and the media. It shares pragmatist commitments to a highly participative version of democracy, attained through the active involvement of all members of society in democratic processes and rejects claims (...) of universally applicable legal “truths” in favour of the constant negotiation of laws between members immediately affected by a law. Pragmatism’s antifoundationalism challenges the dualism between citizens and non-citizens, facilitating the inclusion of the latter in legislative deliberations. (shrink)

In this book, Julius M. Moravcsik disputes that a natural language is not and should not be represented as a formal language. The book criticizes current philosophy of language as having an altered focus without adjusting the needed conceptual tools. It develops a new theory of lexical meaning, a new conception of cognition-humans not as information processing creatures but as primarily explanation and understanding seeking creatures-with information processing as a secondary, derivative activity. In conclusion, based on the theories of (...) lexical meaning and cognition, this work sketches an argument showing that the human understanding of human understanding must always remain just partial. This article sets out to explore the way in which Western science and technology was received in the Mbeere Mission of central Kenya since August 1912 when a medical missionary, Dr T.W.W. Crawford, visited the area. In his dalliance with ecclesiastical matters, Crawford, a highly trained Canadian medical doctor, was sent by the Church Missionary Society (CMS) at Kigari-Embu, in 1910, to pioneer the Anglican mission in the vast area that included Mbeereland, where Mbeere Mission is situated. Contending with the (...) African indigenous knowledge in medicine, environmental conservation, agriculture and other forms of indigenous science, the introduction of Western science and technology, 1912 to 1952, the article argues, did not erase the former; rather, it complimented it. Pockets of general resistance were evident, though Mbeereland, unlike its neighbouring Mutira Mission of 1912, did not offer elaborate opposition to the Western science and technology, partly because the locals could have learnt about it from their neighbours who had experienced it much earlier. Through a historico-narrative design, the research article endeavours to primarily review the coming of Western medicine in Mbeereland: Did it conflict with the African medicine? Methodologically, the data have been collected via archival sources, oral interviews and by reviewing applicable literature.Contribution: The input of this research article to the HTS Journal’s vision and scope is seen by appreciating its focus on the interface between African indigenous knowledge and the European science and technology. Originally published in 1990, this book centres on a certain way of surveying a variety of theories of language, and on outlining a new proposal of meaning within the framework set by the survey. One of the key features of both survey and proposal is the insistence on the need to locate theories of language within a large framework that includes questions about the nature of thought and about general ontological questions as well. The book deals in an interconnected way (...) with both very general and specific issues. At one end of this spectrum there are discussions of the contrast between realist and nominalist ontologies, while at the other are analyses of specific lexical items of English. (shrink)

Some historians have always erred in ignoring oral history methods, as it is always assumed wrongly that the only reliable and trustworthy source of history is the written word. The aim of this article is to underscore the nature and significance of oral histories, which rely on the memory of the narrators. In the case of both Ngugi wa Thiong’o’s and Wole Soyinka’s literary works, their respective childhood experiences are well captured, as they employ both the use of postcolonial and (...) autobiography theories in their theoretical frameworks. In its methodology, this article relied heavily on extensive literature review, oral interviews and archival sources. In seeking to demonstrate the significance of oral history for the preservation of memory and for the writing of history in Africa, the author intends to build from both the above literary works and other theohistorical materials so as to convey the message that the methodology used in chronicling East African oral history, the history of Christian doctrines, Church history or social histories will require us to go beyond postcolonial theory and the theory of autobiography in order to harvest the rich and forward-moving historiographies that remain unexplored and/or unpublished altogether. Contribution: Memory as a critical tool that moves humanity forward is the main subject of this article. The article is relevant to the journal HTS Teologiese Studies/Theological Studies and the world of scholarship as it undertakes a multidisciplinary approach in engaging literary works with theo-historical works in order to build the case for oral techniques in modern scholarship. Christina Landman is a professor of Theology at the Research Institute for Theology and Religion, University of South Africa. As an East African serving under her as a research fellow at the Research Institute of Theology and Religion since 2014, and as somebody whose articles have been published in the two journals where she has been the editor, I can only honour her by contributing to her festschrift and in basing my reflections on my understanding of theological education in tropical (...) Africa, where she plays a critical role – despite my bias towards East Africa, and Kenya in particular. In other words, the goal of this article is to focus on the future of theological education in Africa, with special reference to Eastern Africa, and Kenya in particular. How has Africa journeyed with theological education since its inception in the 19th and 20th century? How is it reflected in the academic institutions of higher learning, in ministerial training, in general academic contexts and in local congregations? Is it Africanity without ethics? Does it have a future? In addressing these concerns, the article employs historic-analytical design in its endeavour to assess the efficacy of theological education as an agent of social transformation in 21st-century Africa. Considering that Africa cannot be identified as a single geocultural context and/or as a monolithic entity, the article builds its case by mainly referring to the Kenyan context. Its methodology includes an extensive literature review of some materials that are connected to theological education, participant observation and personal reflections as an educationist in an African context. The methodology will also include the Protestant divinity school that was established in Frere Town, Mombasa, and later shifted to Limuru, Central Kenya, in 1929. It is set on the premise that the future of theological education in Africa is guaranteed by the growing interest in theological education among the youth, especially in the 21st century. (shrink)

Njega wa Gioko was one of the pioneer Chiefs in Kirinyaga county of Kenya. The other pioneer Chief in Kirinyaga county was Gutu wa Kibetu who reigned in the Eastern part of Kirinyaga county. Gioko reigned in the western part of Kirinyaga county that extended to some geographical parts of the present-day Nyeri county and the present-day Embu county. Njega also became the first paramount Chief of Embu district, which refers to the present-day Embu and Kirinyaga counties. As colonial hegemony (...) and the protestant missionary enterprises, and its resultant evangelical theology, began to shape up in the present-day Kirinyaga county and the surrounding areas between 1904 and 1906, it found Gioko and Kibetu as the Athamaki. The evangelical European missionaries who were comfortable with the colonial expansion, as it provided western governance structures that favoured their enterprises, employed Calvinistic theology in their dealings with the colonial government, and they dealt with the local leaders, who were eventually ‘promoted’ to the post of Chiefs in 1908 by the new rulers. Nevertheless, the missionary’s emphasis on unrealised eschatology differed sharply with those of Athamaki who were the custodians of African indigenous religion and its resultant emphasis on realised eschatology. As an agent of African religion, how did Gioko relate with the early 20th-century evangelical European missionaries and their Calvinistic tendencies that favoured the Church–State relationship as the way of God? The data for this research article are gathered through oral interviews, archival sources and extensive review of the relevant literature.Contribution: This article contributes to the journal’s vision and scope with its focus on the early protestant theologies of the European Missionaries of the 19th and 20th centuries, and their resultant clashes with the theologies of African indigenous religion. As a multidisciplinary article that builds on a theo-historical design, the article contributes to the ongoing discourses on gospel and culture. (shrink)

In citing some qualitative case studies and in building on analytical-survey research design, this article explores the place of African women in warding off the pandemics, with particular reference to coronavirus disease 2019 (COVID-19) in its initial stages (March 2020). With Africa being the most religious continent in the 21st century, African women who led the onslaught against COVID-19 (refer to Ellen Johnson Sirleaf [EJS], Graca Machel, Ngozi Okonjo-Iweala, Vera Songwe, Maria Ramos, Zanetor Agyeman-Rawlings, Yvonne Aki-Sawyerr and Blen Sahilu, among (...) others), were largely informed by a religio-cultural concern for the ‘other’ (ubuntu). In demonstrating their sociocultural role of standing out as the bulwark against threats to familyhood, African women met in Monrovia-Liberia on 08 March 2020 during the inauguration of Amujae Leadership Forum that cropped up as a barricade against further COVID-19 spread. In a nutshell, the article draws from Sirleaf’s approach in combating the 2014–2016 Ebola pandemic and samples other leading African women’s contributors who played a pivotal role in responding to the initial stages of the pandemic, a phenomenon that traces its roots from the African heritage.Contribution: This article foregrounds the interface between African women, religious inspiration and health-related matters; and indeed enriches HTS Journal and the academic world. As by-products of a religiously inclined continent, African women’s initial response to the pandemic in March 2020 is well-rooted in their religio-cultural backcloth. (shrink)

This article sets out to demonstrate the role of the ‘one-legged devil’, also called General Kassam. Kassam was one of the pioneer generals of the Mau Mau, a guerrilla movement that operated from the central Kenya forests as they participated in the war of liberation from the early 1950s to the early 1960s. Was Kassam a one-legged general from the word go? Methodologically speaking, the article is partially based on interviews conducted with the general before his death at the age (...) of 89 in 2011. Being an insider, Kassam helped to give an in-depth understanding of the Mau Mau war of independence by relating the role of the Kavirondo people of western Kenya in Mau Mau historiography. Were they enticed by the colonial government to abandon the idea of the armed struggle as a way of writing off colonialism? Or did the Kavirondo embrace the theology of non-violence and eventually left the central Kenya group to battle it alone? Or were the people of western Kenya dissuaded to take part in the struggle by the Christian ‘gospel of love’ that abhorred violence, leading to abandoning their colleagues from central Kenya at the last minute? Theoretically speaking, the article is largely informed by John Walton’s theory of reluctant rebels. Walton argues that rebels are always incited by the leading elites in a society that undergoes war or civil war at any given time in history.Contribution: The article contributes to growing knowledge by discussing the Mau-Mau Movement in Kenya’s quest for freedom, from the 1950s to early 1960s, to demonstrate the religious role of armed conflicts in Africa. In this case, General Kassam, a baptised Anglican Christian, whose loyalty to the ancestral pantheons drove him to the quasi-religious war of independence, is the key subject in this article. In this war of independence in Kenya, a seeming conflict between African religion and Christian religion appears as a key emerging issue. The article is relevant to the HTS Journal and the world of scholarship because it is a theo-anthropocentric piece of work which deals with God, creation, and inevitable human conflicts – all of which have answers before God. The research study sets out to explore the contribution of the African Evangelicals in both the colonial and post-colonial Kenya to the social lives of the nation. Can’t it be viewed as a positive social influence or an ecclesiastical pitfall? In utilising a socio-historical design, it poses the question: how did the Evangelical European Missionaries demonstrate their theological and social influences in Kenya, and how did the post-missionary Evangelical-leaning leaderships play out? And was Muthirigu Dance an extremist reaction against the (...) rigidity of the Evangelicals? Methodologically, this article will attempt to explore the Evangelical European Missionary Christianity, especially the Church Missionary Society that entered Central Kenya in the early 1900s, and assess the way in which they handled indigenous cultures of the local Africans. It has also attempted to critically explore their social influences in both colonial and post-colonial Kenya. The CMS has been given more emphasis in this article as an Evangelical society so as to help in bringing out the specific Evangelical activities in the Kirinyaga County of Kenya. Overall, the article has endeavoured to hypothesise that Eurocentrism was not the Evangelical problem, as there were diverse European missionaries, such as the High Anglican Church, the Roman Catholic and the Lutherans who were non-Evangelicals, and who were not necessarily dogmatic and rigid.Contribution: This study adhered to the HTS journal’s vision and scope by its focus on the histories of the Evangelical European Missionaries of the 19th and 20th centuries, their interactions with the local religio-cultures, and how it later played out amongst the Africans. In his book, Wizard of the Crow ( 2007 ), the renowned Kenyan novelist, Ngugi wa Thiong’o, expresses the view that a successful society is only guaranteed when women issues are well settled. In light of post-colonial Africa and the era of COVID-19, African women – like the biblical Miriam, the co-liberator with Moses and Aaron (Mi 6:4) – are seen as Nyawiras (plural for Nyawira, the hardworking woman), as their critical role in preserving the family and society is evident. While relying on a critical review of wa Thiong’o’s works and in engaging a selected religio-cultural literature, the article seeks to explore the role of African women [ Nyawiras ] in societal sustenance. With postcolonial Africa encountering a hotchpotch of challenges, are Nyawiras the best suited persons to deconstruct the status quo and eventually reconstruct the ‘sick’ society under greedy-grabbing male-leaders of nation-states (Aburirias) that have lost their moral compasses? Are women best suited to bring back sanity; and have they crossed the Rubicon in the 21st century? In drawing from diverse examples from Africa and beyond, the research article will be significant in helping the modern African society understand the myriad of problems they are facing in the local and global scene, and eventually appraise women’s heroine roles. Contribution: This research uses a multi-disciplinary approach and engages a dialogue between African literature and Africa’s religio-cultural discourses in order to better understand the complex situation facing Africa. The article sets out to demonstrate the need for theopastoral education in tropical Africa, by showcasing St. Andrew’s College, Kabare, in Central Kenya. The statement of the problem therefore is: How has St. Andrew’s College, Kabare, journeyed with its establishment as a centre of theopractical education? This will drive us to methodologically employ historical-analytical design in our bid to understand the intrigues behind the formation and growth of the institution. As it prepares to graduate from a diploma college to a (...) university, how has it wrestled with the challenges in its endeavour to reconstruct theological and pastoral education? The article sets on the premise that the nature of theological articulation in the East African region, as propounded by the then-all powerful East African Revival Movement, needed theopastoral reconstruction via establishment of an institution that would thoroughly address relevant concerns. To this end, the first synod of the diocese of Mt Kenya East, held at St. Andrew’s Church, Kabare, on 26 August 1975, requested the standing committee of the synod to appoint a commission to investigate the future plans of lay and clergy training and report this matter to the next synod. In other words, the first synod of the new diocese foresaw the birth of St Andrew’s as a centre of theological education and holistic training. In view of this, the article will explore the intrigues behind this process in a bid to show its relevance for the rest of the tropical Africa. (shrink)

Hemiparetic stroke in adulthood often results in the grouped movement pattern of the upper extremity flexion synergy thought to arise from an increased reliance on cortico-reticulospinal pathways due to a loss of lateral corticospinal projections. It is well-established that the flexion synergy induces reaching constraints in individuals with adult-onset hemiplegia. The expression of the flexion synergy in individuals with brain injuries onset earlier in the lifespan is currently unknown. An early unilateral brain injury occurring prior to six months post full-term (...) may preserve corticospinal projections which can be used for independent joint control and thus minimizing the expression of the flexion synergy. This study uses kinematics of a ballistic reaching task to evaluate the expression of the flexion synergy in individuals with pediatric-onset hemiplegia (PH) ages six to seventeen years. Fifteen individuals with brain injuries before birth (n = 8) and around full-term (n = 7) and nine age-matched controls with no known neurological impairment completed a set of reaches in an admittance controlled robotic device. Descending drive, and the possible expression of the upper extremity flexion snergy, was modulated by increasing shoulder abduction loading. Individuals with early PH achieved lower peak velocities when reaching with the paretic arm compared to controls however no differences in reaching distance were found between groups. Relative maintenance in reaching seen in individuals with early brain injuries highlights minimal expression of the flexion synergy. We interpret this conservation of independent control of the paretic shoulder and elbow as the use of more direct corticospinal projections instead of indirect cortico-reticulospinal pathways used in individuals with adult-onset hemiplegia. Introduction: Physical distancing under the coronavirus disease 2019 pandemic had a significant impact on lifestyles, including exercise routines. In this study, we examined the relationship between mental health and addictive behaviors, such as excessive exercise and the use of image and performance enhancing drugs across 12 sport disciplines.Materials and methods: A large cross-sectional sample of the adult population was surveyed. The mean age was 33.09. The number of male participants was 668. The use of IPEDs was assessed in conjunction with (...) psychometric measures such as the Exercise Addiction Inventory and the Appearance Anxiety Inventory. The participants were grouped into activity group and non-activity group according to the presence or absence of their exercise habits. The results were compared between these groups, as well as across sport disciplines, while taking into account the relationship between different psychological measures and IPEDs consumption.Results: The frequency of IPEDs use was higher among AG than NAG, although AG participants reported less history of addictions than NAG. The logistic regression analysis revealed that scores equal to or above cutoff points, in both the EAI and AAI, predicted the IPEDs use. Regarding the differences across the various sport disciplines, those who were involved in practicing Weight Lifting and Cross Fit were found to be more at risk of excessive exercising and more inclined to use a wide range of IPEDs.Conclusions: Although exercise could help to increase well-being and prevent addictions during the COVID-19 pandemic, our results show that those in the AG are particularly vulnerable to excessive IPEDs use. Sport disciplines associated with higher EAI and AAI scores have also shown a higher tendency to excessive IPEDs use. Furthermore, the factor of having above the cutoff scores in EAI or AAI in each sport could indicate larger IPEDs consumption regardless of the discipline. In light of the current findings, it is necessary to better define the “non-excessive” levels of exercise in various sport disciplines and an adequate intake of IPEDs to ensure the safety and well-being of people during a pandemic. Edible insects are a potentially less burdensome source of proteins on the environment than livestock for a majority of rural consumers. Hence, edible insects are a timely idea to address the challenges of the supply side to sustainably meet an increasing demand for food. The objective of this paper is twofold. The first is to identify and compare rural-households’ intentions to consume insect-based foods among households drawn from two regions in Kenya—one where consumption of insects is common and the other (...) where the practice is uncommon. The second is to explore consumers’ trust in sources of information regarding quality and appropriateness of food items. The study employed an extended theory of planned behaviour and involved 432 participants. Results indicate that rural households have positive intentions to consume insect-based foods and those intentions are higher for individuals who are more familiar with the practice. Results also show that information sources from industry are more trusted than those from the media. Further, the study revealed that control variables such as perceived availability of insect-based foods and their level of fit with the culinary practices have a higher influence on consumption intentions than general attitudes. In addition, age of the respondent, gender, household size and level of formal education, significantly influence the consumption intentions. The study discusses the implications of these findings in the development of sustainable agri-food systems. (shrink)

This volume addresses a wide variety of moral concerns regarding slavery as an institutionalized social practice. By considering the slave's critical appropriation of the natural rights doctrine, the ambiguous implications of various notions of consent and liberty are examined. The authors assume that, although slavery is undoubtedly an evil social practice, its moral assessment stands in need of a more nuanced treatment. They address the question of what is wrong with slavery by critically examining, and in some cases endorsing, certain (...) principles derived from communitarianism, paternalism, utilitarianism, and jurisprudence. In Plato's Theaetetus Socrates is portrayed as a midwife of the intellect. The comparison of Socratic questioning to midwifery had until recently been commonly attributed to Socrates himself. In 1977 M. F. Burnyeat published Socratic Midwifery, Platonic Inspiration, which transformed the way in which the dialogue has since been perceived. The author maintains that the midwife comparison is in no sense to be attributed to the historical Socrates.

Humans are unconditionally confronted with social expectations and norms, up to a degree that they, or some of them, have a hard time recognizing what they actually want. This renders them susceptible for introjection, that is, to unwittingly or “unconsciously” mistake social expectations for self-chosen goals. Such introjections compromise an individual’s autonomy and mental health and have been shown to be more prevalent in individuals with rumination tendencies and low emotional self-awareness. In this brain imaging study, we draw on a (...) source memory task and found that introjections, as indicated by imposed tasks that are falsely recognized as self-chosen, involved the bilateral medial prefrontal cortex and the dorsal anterior cingulate cortex. Notably, reduced right MPFC activation within this condition correlated with trait scores of ruminations and reduced emotional self-awareness, but also introversion. Moreover, correct recognition of tasks as self-chosen involved the right MPFC. Accordingly, the right MPFC may play a role in supporting the maintenance of psychological autonomy and counteract introjection, which individuals with certain personality traits seem to be prone to. This research has significant implications for the study of mechanisms underlying autonomous motivation, goal and norm internalization, decision-making, persuasion, education, and clinical conditions such as depression and burnout. Background: Neurotypical young adults show task-based modulation and stability of their eye movements across tasks. This study aimed to determine whether persons with aphasia (PWA) modulate their eye movements and show stability across tasks similarly to control participants. Methods: Forty-eight PWA and age-matched control participants completed four eye-tracking tasks: scene search, scene memorization, text-reading, and pseudo-reading. Results: Main effects of task emerged for mean fixation duration, saccade amplitude, and standard deviations of each, demonstrating task-based modulation of eye movements. Group by (...) task interactions indicated that PWA produced shorter fixations relative to controls. This effect was most pronounced for scene memorization and for individuals who recently suffered a stroke. PWA produced longer fixations, shorter saccades, and less variable eye movements in reading tasks compared to controls. Three-way interactions of group, aphasia subtype, and task also emerged. Text-reading and scene memorization were particularly effective at distinguishing aphasia subtype. Persons with anomic aphasia showed a reduction in reading saccade amplitudes relative to their respective control group and other PWA. Persons with conduction/Wernicke’s aphasia produced shorter scene memorization fixations relative to controls or PWA of other subtypes, suggesting a memorization specific effect. Positive correlations across most tasks emerged for fixation duration and did not significantly differ between controls and PWA. Conclusions: PWA generally produced shorter fixations and smaller saccades relative to controls particularly in scene memorization and text-reading respectively. The effect was most pronounced recently after a stroke. Selectively in reading tasks, PWA produced longer fixations and shorter saccades relative to controls, consistent with reading difficulty. PWA showed task-based modulation of eye movements, though the pattern of results was somewhat abnormal relative to controls. All subtypes of PWA also demonstrated task-based modulation of eye movements. However, persons with anomic aphasia showed reduced modulation of saccade amplitude and smaller reading saccades, possibly to improve reading comprehension. Controls and PWA generally produced stabile fixation durations across tasks and did not differ in their relationship across tasks. Overall, these results suggest there is potential to differentiate among PWA with varying subtypes and from controls using eye movement measures of task-based modulation, especially reading and scene memorization tasks.
